Terms of Use

The Site located at https://idea-sa.gr (hereinafter referred to as “the Site”) is a copyrighted work belonging to “IDEA INVESTMENTS SOCIÉTÉ ANONYME” (hereinafter referred to as “the Company”). Any and all intellectual property rights associated with the Site and its contents belong to the Company and its affiliates.

These Terms of Use describe the legally binding terms and conditions that direct the use of the Site. BY LOGGING INTO THE SITE, IT IS PRESSUMED THAT YOU COMPLY WITH THESE TERMS and you declare that you have the authority and capacity to enter into these Terms. The Site should only be used by authorized entities and persons who have reached the age of legal maturity and are competent to enter into legally binding agreements under the applicable law. If you do not qualify or disagree with the provisions herein, do not log in to/use the Site.

Access to the Site

Subject to these Terms. The Company grants you a non-transferable, non-exclusive, revocable, limited license to access and use the Site. This access license does not entail any rights or title in respect to any intellectual property rights, except for the limited access rights expressed below. The Company reserves all rights not expressly granted in these Terms.

Certain Restrictions.  Except as otherwise expressly stated in these Terms, you shall not copy, reproduce, display, make derivative works from, transmit and/or distribute the intellectual property of the Site in any form or by any means, without the Company’s prior written consent. All copyright and other proprietary notices on the Site must be retained on all copies thereof. Any future updates relevant to the functionality of the Site shall be subject to these restrictions as well. 

The Company reserves the right to revise these Terms and/or change, suspend or cease the Site at its sole discretion, without noticing you. You acknowledge that the Company will not be held liable for any such modification.

No Support or Maintenance. You agree that the Company has no obligation to provide you with any support in connection with the Site.

User Content

User Content. “User Content” means any and all information and content associated to the user of this Site. You are exclusively responsible for your User Content and you acknowledge that you bear all risks associated with such choice.  You hereby certify that your User Content does not violate our Terms of Use and Privacy Policy (jointly referred to as the “Policies”).  You may not deduce or affirm others that your User Content is in any way provided, sponsored or endorsed by the Company.

Acceptable Use Policy.  You hereby consent to the following:

• You shall not attempt to gain unauthorized access to the Site by any means.
• You shall not access or use the services, information, applications, or software available at the Site in a way not expressly permitted.
• You shall not to use the Site to collect, upload, transmit, display, or distribute any content that (i) violates any third-party’s right, including intellectual property and proprietary rights; (ii) is unlawful or in non-compliance with all applicable laws, rulings, and regulations; (iii) is false or misleading; (iv) may contain viruses or other computer programming routines that are intended to alter, damage, intercept or expropriate any system, data, the Site or information or that infringes the Intellectual Property rights of any third party.

The Company reserves the right to review the User Content and take appropriate measures in case it violates its Policies or any legal provisions. Such measures may include requesting you to remove or modify your User Content. In case of non-compliance, the Company reserves the right to terminate your Account.

Disclaimers

The Site is provided on an “as-is” and “as available” basis. The Company and its affiliates disclaim any and all warranties and conditions of any kind, whether express, implied or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement of third parties’ rights.  The Company does not guarantee that the Site will meet your requirements and makes no representations concerning the accuracy and completeness of the content and/or the uninterrupted,  secure or error-free use of the Site.

Limitation on Liability

To the extent permitted by the Greek law, in no event shall the Company be liable to you or any third-party for any lost profits and/or damages resulting from the use or the incapability to use the Site.  Access to and use of the Site is at your own discretion and risk and you alone will be responsible for any damage.

Termination of Terms

General

Applicable Law. These Terms are governed and will be interpreted in accordance with Greek law. Any disputes relating to these Terms will be exclusively subject to the jurisdiction of the Greek courts of Athens.

Entire Terms. These Terms constitute the entire agreement between you and the Company regarding the use of the Site.

Exercise of Rights. Our delay or failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

Headings of No Effect. The selection of titles in these Terms are for reference purposes only and shall not in any way affect the meaning or interpretation of these Terms.

Void or Invalid Provision. If any provision of these Terms is held to be illegal, invalid or unenforceable, the validity of the remaining provisions shall be unaffected.

Assignment of Rights. Your rights and obligations herein may not be assigned, subcontracted, delegated or otherwise transferred by you without Company’s prior written consent. Any attempted assignment, subcontract, delegation or transfer in violation of the foregoing will be null and void.
